Understanding Executive Sessions
South Carolina law allows County Council to meet in executive session for certain limited purposes. These may include receiving legal advice involving attorney-client privilege, discussing proposed contractual arrangements or property transactions, personnel matters, and matters involving the proposed location or expansion of a business or industry.
An executive session is a normal and legally authorized part of local government proceedings when used for one of the purposes permitted by South Carolina law.
What the public should know
- The meeting and agenda remain public. Regular and special meetings generally require a publicly posted agenda at least 24 hours in advance.
- Council must vote publicly before entering executive session. The presiding officer must announce the specific purpose for entering the closed session.
- Some details may remain confidential. For certain economic-development discussions, South Carolina law does not require Council to publicly identify the individual company or entity being discussed.
- No action may be taken in executive session. Council may discuss permitted matters privately, but it must return to public session before taking official action.
- A return to open session does not necessarily mean a vote will occur. Council may return and take no action, or it may consider an action that is lawfully before it.
Executive sessions can allow County officials to protect legitimate legal, contractual, personnel, and economic-development interests while still requiring official governmental action to occur publicly.
